Minutes of the monthly meeting of the Town of Olive Town Board, held Tuesday June 9, 2020 7 pm via Zoom link due to the COVID-19 Pandemic.

Supervisor Sofranko asked Board Member Edinger if we were recording and Board Member Edinger advised that we were. Supervisor Sofranko thanked David Edinger for facilitating all the meetings for the Town. The meeting was called to order at 7:00pm.

On a Sofranko/Boggess motion the following changes were made to the May minutes:
Resolution #12 of 2020 Ordinance amendments line 2, change article 9 to article 7.
Line 5 change article 9 (7) to just article 7.
Include May budget modifications that were left out of minutes in error.

To Adopt Ordinance Amendments to Chapter 150 of the Town of Olive Code
Whereas, the Town of Olive Town Board, held a Public Hearing on June 8, 2020 at 6:45pm on the Zoom meeting platform, regarding proposed ordinance amendments to the Town of Olive Local Law, Chapter 150, as directed by NYS Town Law §130 and,

Whereas, the Town Clerk gave public notice of the date, time and place of the Public Hearing on the ordinance amendments to Town of Olive Local Law, Chapter 150, as required under NYS Town Law §130, in the Daily Freeman newspaper of Kingston, NY,

Whereas, the date, time and place of the Public Hearing on the ordinance amendments to Town of Olive Local Law, Chapter 150, was further publicized by placing a public notification on the Town of Olive website and,

Whereas, the Town of Olive Town Board received no comments from the public during the Public Hearing or any correspondence from the public on the proposed ordinance amendments to Town of Olive Local Law, Chapter 150, and,

Now, Therefore Be It Resolved, The Town of Olive adopts the amendments to the Code of the Town of Olive, Chapter 150, to include the following:

Article 1 – Parking

§150-1. Definitions

§150-2. Prohibited Parking

§150-3. Authority to Impound Vehicles

Article 1 – Parking

§150-1. Definitions
Whenever used in this article, unless otherwise expressly stated or unless the context or subject matter requires a different meaning, the words and phrases shall have the meanings respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York.

§150-2. Prohibited Parking.
A – The parking, standing or stopping of vehicles is prohibited in the Town of Olive, Ulster County, New York where official signs prohibiting parking, standing or stopping are located.
The parking of vehicles is prohibited at any time in either direction 1200’ from the intersection of Coldbrook Road and NYS Route 28A in Boiceville, Town of Olive, Ulster County, New York.
B – The parking of vehicles is prohibited in the Town of Olive, Ulster County, New York in any designated handicapped parking locations without a permit.
C – The parking of vehicles is hereby prohibited overnight on all town roads or highways situated in the Town of Olive, Ulster County, New York during the period between November 1 of each year through and including April 1 of each year.

§150-3. Authority to Impound Vehicles.
A – Any vehicle that is parked on any town highway or road in the Town of Olive, Ulster County, New York, where parking is prohibited may be removed under the direction of the Police Department of said Town of Olive.
B – Any vehicle that is parked or abandoned on any town highway or road for more than 24 hours or within the right-of-way of any town road or highway of the Town of Olive, Ulster County, New York may be removed under the direction of the Police Department of said Town of Olive.

§150-4. Storage and Charges
After removal of any vehicle as provided in §150-3 hereinabove, such vehicle so removed shall be stored in a suitable place at the expense of the owner. The owner or person in charge of such vehicle may redeem the impounded vehicle upon payment to the Town Clerk of the amount of all expenses actually and necessarily incurred in effecting such removal, together with storage charges. The said Town of Olive shall not be liable for any damage or loss of property as a result of the removal or storage.

§150-5. Penalties for Offenses.
Every person convicted of violating any provision of this article shall be guilty of a traffic infraction and shall for the first conviction thereof be punished by a fine of not more than $75 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second or subsequent such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $150 or by imprisonment of not more than 45 days, or by both such fine and imprisonment.

Parks/Recreation: On a Boggess/Kelder motion, the Town Board “empowered the Supervisor to make the decision on the opening of the Olive Pool and the Olive Summer Day Camp in collaboration with Olive Pool and Facilities Director Gene Sorbellini, the Olive Recreation Committee, Recreation Committee Town Board Liaison Scott Kelder and individual Town Board members. In addition, the decision to open the pool will be based on adhering to the guidelines established by the Center for Disease Control, the NYS Department of Health and the Ulster County Department of Health as well as recommendations from NYMIR, the Town of Olive Liability Insurance carrier, and the Town of Olive legal counsel.”

Cable Franchise Negotiations Committee-Jim Sofranko, Chair
The committee has not met but Supervisor Sofranko spoke with Kevin from Spectrum about a possible package and build out on private road Grace Way. He also noticed they have been doing some surveying along County Road 3.

Parks & Recreation Committee-Scott Kelder, Liaison
Board Member Kelder stated it has been a crazy week to figure out directives for pool and day camp with social distancing and masks in 95 degree heat. Supervisor Sofranko hopes the public understand why the Town is holding off as long as we can. Any Decision the Board makes will need to following guidelines and take liability into consideration. The Town is hoping to have the pool ready by July 3rd and Day Camp by July 6th.

Highway Superintendent-Brian Burns
Superintendent Burns stated that the Culverts pipes for Upper Boiceville Road, DeSilva Road and Burgher Road is out to bid with bids due back in the Town Clerks office by July 8th at 10 am. The Highway Department will be doing road work on Acorn Hill, Brown Road, Lang Road and Blueberry Hill. Superintendent Burns was concerned about road signs being stolen last month he says the cost to replace these signs can add up. He was also concerned with the amount of trash (rubber gloves) being thrown along the roads.

Supervisor Sofranko spoke with Police Chief Ryan about mandatory diversity training for all Town of Olive Police Officers.

Town Clerk-Dawn Giuditta (#70-20)
May Monthly Report- $26,955.52
May Tax Collection $243,809.82
Zoning Board Training 2019- All have 4 hours except Paul Wright -2 hours due to being appointed in September and Chet Scofield- 2 hours (#71-20).
Planning Board Training 2019- Steve Dibbell – 5 hrs. Helene Grant- 2 hrs. Everyone else did not do any training in 2019. Heidi Emrich was just appointed in September. (#72-20)

Scenic Byway-Drew Boggess, Liaison
They did not meet but have purchased several pounds of pollinator seeds.

Conservation Advisory Council- David Edinger, Liaison
The Council is getting the Natural Resource Inventory together would like to present it to the Board in the next couple of months. They have also been working on the Community Choice Aggregation and it’s just a matter of getting an administrator to present to the Board.

Technology Committee- David Edinger, Chair
The Committee has not met but the plan is to complete the Technology Policy by end of summer. Board Member Edinger has been doing a lot of research on what the new website should entail.

Zoning Committee- Drew Boggess, Chair
The Committee met in May and they may have identified a number of areas that they think they can tackle on their own in the zoning code. The Committee is trying to come up with suggestions to certain sections of the code and decide what to do from there. Depending on how extensive this first phase becomes, legal input might be required.

Buildings & Grounds Committee-Scott Kelder
The Committee is still tabled until September.

Barry Ruland, LVDV Operations Chief Operator sent the Town Board the Boiceville Sewer District Monthly Operating Report for May 2020. (#73-20)

All pertinent business having been discussed the meeting was adjourned on Sofranko/Read motion at 8:20 pm in memory of Charles Henry Hummel Sr., Eileen (Phelan) Monarch and Robert Davis.
