Minutes of the public hearing on Local Law #2 of 2020, held Monday, September 14, 2020 6:30 pm at Davis Park in West Shokan, NY 12494 due to the COVID 19 Pandemic.

There were no other residents in attendance.

Supervisor Sofranko called the public hearing to order at 6:30 pm.

Town Clerk, Dawn Giuditta read the legal ad for the public hearing that ran in the Daily Freeman.

On a Boggess/Read motion the public hearing was adjourned at 6:50 pm.

Minutes of the audit meeting of the Town of Olive Town Board, held September 14, 2020 7 pm at Davis Park in West Shokan, NY 12494.

Supervisor Sofranko called the meeting to order at 6:51 pm.

On a Sofranko/Kelder motion, the Town Board approved the use of the Grant Avery Park facilities for flag football and little league.

On a Sofranko/Boggess motion, the Town Board approved the Bushkill Rod & Gun Club use the facilities at Grant Avery Park for a drive through BBQ on the condition they provide insurance certificate.

Supervisor Sofranko read the following Wireless Telecommunications Facilities Siting Law for the Town of Olive narrative description into the record:

The Telecommunications Act of 1996 affirmed the Town of Olive’s authority concerning the placement, construction and modification of wireless telecommunications facilities. The Town Board of the Town of Olive finds that wireless telecommunications facilities may pose a unique hazard to the health, safety, public welfare and environment of the Town of Olive and its inhabitants. The town also recognizes that facilitating the development of wireless service technology can be an economic development asset to the town and of significant benefit to the town and its residents. In order to ensure that the placement, construction or modification of wireless telecommunications facilities is consistent with the town’s land-use policies and federal law, the town is adopting this comprehensive wireless telecommunications facility application and permit process. The intent of this article is to minimize the negative impact of wireless telecommunications facilities, establish a fair and efficient process for review and approval of applications, ensure compliance with federal law, assure an integrated and comprehensive review of environmental impacts of such facilities and protect the health, safety and public welfare in the Town of Olive. The Town of Olive lies entirely within the Catskill Park. It is in a visually sensitive area, with views of mountaintops and ridge lines that are important assets to the residents.

On a Sofranko/Boggess motion, the Town Board declared the Town of Olive be the lead agency as per NYS Environmental Quality Review (SEQR) for proposed Local Law #2 of 2020.

On a Sofranko/Read motion, the Town Board declared proposed Local Law #2 of 2020 be made a Type 1 Action.

On a Sofranko/Edinger motion, the Board completed a Full Environmental Assessment Form parts 1, 2 and 3 of the proposed Local Law #2 of 2020.

Board Member Boggess read the response from the Ulster County Planning Board for Local Law #2 of 2020 Chapter 146, Wireless Telecommunications Facilities Law. He stated for the record that he is appointed to the Ulster County Planning Board to represent the Town of Olive, therefor he recused himself from UC Planning Board vote. (#96-20)

After review of the SEQR, the Town Board on a Sofranko/Boggess motion declared a negative declaration of the proposed Local Law #2 of 2020 as having no significant adverse impact on the environment in the SEQR Determination of Significance.

The Town Board members were sent reports from Janice Lanzarotta, Bookkeeper Statement of Expenditures, Encumbrances & Appropriations (7/31/20) #97-20 and Dianna Carchidi, Assessor August Sales & Market Report #98-20. Dianna Carchidi was present at the meeting to discuss her report with the Board.

The Town Board audited the monthly bills and discussed the following topics:

• Separation Agreement with Joseph Minew and the withdrawal of the Highway Grievance.
• Lower Sahler Mill Rd development and sending out RFP’s for an Engineering firm to support the Planning Board.
• The Bushkill Stream and Streambank Project has been nearly completed, there are some plantings that will be done in November.
• The Boiceville Culvert Pipe Project has been started by Baker Bros.
• Vandalism at the pool.
• Planning Board applications for a new member.

All pertinent business having been discussed the meeting adjourned on Sofranko/Edinger motion at 8:13 pm.
